Every three months, the Election Commission gazettes a supplementary roll for each state, detailing the voters who have been removed, the voters added and the voters who have changed their address. This roll is displayed for two weeks and is also sold by the Election Commission.
Working with the Malaysian Electoral Roll Analysis Project (MERAP), we are constantly running checks on the electoral roll to find any discrepancies, which can then be further investigated and publicised.
So far, MERAP has exposed an entire book of evidence on the electoral roll. Some names, with the same address and the same IC number (except for the last 2 digits), are on the roll multiple times. In other cases, there are hundreds of people living in one house.
The People's Tribunal Report on GE13 found “there is strong evidence of various inaccuracies on a scale so great in GE13 that there is reason to suppose that this is designed to set the scene for fraud”.
The People’s Tribunal cited evidence that people were registered to vote without their knowledge, people were registered in constituencies hundreds of miles from their homes, and people had been removed from the electoral roll without their knowledge.
The Royal Commission of Inquiry (RCI) on illegal immigrants in Sabah also found there were non-citizens on the electoral roll. The names and identities of thousands of these non-citizens were presented in court in 1999 and MERAP keeps track of where these people are now registered to vote. Thousands have moved to Peninsula Malaysia, and now vote in cities like Klang and Johor Baru.
BERSIH 2.0 is working hard on challenging the long list of frauds in court, but Section 9A of the Elections Act makes this very, very difficult. This clause was inserted into the Act after the High Court in Sabah ruled the election of former Chief Minister Yong Teck Lee was null and void because of non-citizens on the roll. The inserted clause says:
“After an electoral roll has been certified or recertified…the electoral roll shall be deemed to be final and binding and shall not be questioned or appealed against in, or reviewed, quashed or set aside by, any court.”
This openly undemocratic law must be repealed. It allows all the fraud and manipulation to continue without any chance to make a court challenge. Lawyers are working hard to find a way around this clause, but the fraud in our elections continues.
